## Content

## In Short
South Africa’s AI policy is being rewritten after the government pulled its draft over fabricated academic references. Communications minister Solly Malatsi says Cabinet should finalise a replacement policy by end of March 2027.

## What Happened
South Africa’s AI policy process is back in the spotlight after the draft national framework was withdrawn earlier in 2026. The withdrawal followed the discovery of fabricated academic references, a common failure mode of generative AI tools, where systems can produce confident but false citations.

Malatsi told TechCabal that two officials in the communications department were suspended for failing to disclose the use of AI in preparing material linked to the fake references. One of the suspended officials has since resigned. Disciplinary proceedings against the other staffer are still ongoing.

The minister said the department could not let the incident pass without consequences. He also acknowledged the reputational damage caused by AI generated material that went undetected during internal review.

Next steps are now tied to a new timeline. Malatsi said the government expects Cabinet to finalise the replacement AI policy before the end of March 2027. Public consultation is expected to begin in April.

## Why It Matters
AI policy shapes how a country regulates artificial intelligence, including issues like data use, accountability, safety testing, and the rights of citizens affected by automated decisions. For startups and enterprises, it also signals what compliance will look like for AI products and AI powered services.

South Africa has positioned itself as a potential leader in AI governance on the continent. This episode raises practical questions about safeguards inside government, including how policy teams verify sources and how they track AI use in official drafting.

If the replacement policy lands on schedule, it could still set clear rules for procurement, public sector AI use, and future regulation. But the unfinished disciplinary process leaves open a key point for the ecosystem, who is accountable when AI assisted drafting goes wrong.
