## Content

## In Short
Kenya BNPL regulation is moving into the spotlight as lawmakers prepare a review of buy now, pay later and asset finance lenders.

## What Happened
Kenya’s National Assembly Finance and National Planning Committee plans to engage the Central Bank of Kenya (CBK) and financing companies over consumer protection in the BNPL market.

BNPL, short for Buy Now, Pay Later, lets a customer take an item today and pay in instalments over time. It often looks like a lay-by, but the credit is provided upfront by a lender.

The committee, chaired by MP Kuria Kimani, is focusing on motorcycle asset financing and similar instalment credit products. These products are widely used by riders and small business owners who cannot pay the full cost upfront.

Lawmakers want lenders to share details on lending practices, customer registration, licensing status, and compliance with existing financial rules. Kimani also warned that firms that ignore parliamentary invitations could face action under National Assembly Standing Orders.

The scrutiny follows borrower complaints about high repayment costs, extra charges, and aggressive debt recovery. Debt recovery refers to how a lender collects overdue payments, including repossessing financed assets.

The push comes after Kenya expanded CBK oversight in 2024. The Business Laws (Amendment) Act, 2024 widened CBK authority over non-deposit-taking credit providers, including some BNPL and asset finance firms.

Companies active in the broader instalment finance space include [M-KOPA](/m-kopa). The concerns raised are sector-wide and do not, by themselves, prove wrongdoing by any named company.

## Why It Matters
If Kenya tightens BNPL regulation, lenders may need clearer disclosures, stronger affordability checks, and more controlled repossession processes. Affordability checks are basic tests to confirm a borrower can repay without falling into a debt trap.

For BNPL startups and digital lenders, closer CBK supervision could raise compliance costs, but it may also improve trust in instalment credit. For consumers, the review could mean fewer hidden fees and more predictable repayment terms.

The outcome will shape how credit providers price loans, explain contracts, and recover assets in Kenya’s fast-growing fintech market.
