## What Happened
The Federal Competition and Consumer Protection Commission, FCCPC, has released draft Sales Promotion Regulations, 2026. The proposal targets businesses that use artificial intelligence, machine learning, or automated tools for sales promotions and consumer engagement.

Under the draft, businesses using AI marketing that is directed at, or accessible to, Nigerian consumers would need to register that use with the FCCPC. AI in this context includes tools like chatbots, automated messaging, and virtual influencers, which are computer-generated personalities used to promote products.

The rules also propose clear disclosure. AI-generated or automated marketing content should be identifiable as AI-made, so consumers can tell when a message is not created by a person.

The draft adds consumer controls. Companies would be required to offer an opt-out, meaning people can choose to stop receiving automated or AI-driven marketing communications.

## Why It Matters

Another key change is liability. The FCCPC draft says businesses remain responsible for what their AI systems publish. That includes misleading claims, discriminatory outcomes, manipulation, or misuse of consumer data. In practice, companies may need stronger review processes, audit logs, and safeguards around ad copy, targeting, and data handling.

If adopted, the framework would be one of Nigeria’s first direct attempts to regulate AI use in consumer marketing, and it could shape how AI-enabled advertising is run in the market.
