# Capitec Bank Wins Court Order to Repossess R2m Porsche

Capitec Bank won an appeal to repossess a Porsche 911 after a Sandton clinic defaulted. The court said business rescue did not block return.

Capitec Bank has won a legal fight to repossess a Porsche 911 Carrera S from a Sandton health clinic. The Supreme Court of Appeal ruled the clinic had no lawful right to keep the car after the finance agreement was cancelled.

## What Happened
Capitec Bank, a South African retail bank, financed R2.115 million of the Porsche’s R2.35 million purchase price. The borrower, Ubuntu Family Health Centre Grayston, was meant to repay the loan over 60 months.

The agreement included 59 monthly instalments of about R31,639, then a balloon payment of R634,500. A balloon payment is a large final payment at the end of the term.

The clinic fell behind on payments. The bank issued a formal demand in October 2023, giving the clinic seven days to settle arrears.

After the clinic did not pay, Capitec cancelled the agreement on November 17, 2023. Ownership of the vehicle remained with Capitec until all amounts were paid, so cancellation removed the clinic’s right to keep the car.

When Capitec representatives and later auctioneers tried to take possession, the clinic’s director reportedly refused access and did not disclose where the vehicle was. The dispute then moved into court, with the clinic later entering business rescue and eventually being liquidated.

Business rescue is a South African process meant to help a financially distressed company restructure, rather than shut down immediately. The appeal court found that business rescue did not protect the clinic from returning property it no longer had a legal right to possess.

## Why It Matters
For banks and asset finance providers, the ruling reinforces a key point in secured lending. If a finance deal is validly cancelled before business rescue begins, the lender can still pursue recovery of the financed asset.

For SMEs and clinics using asset finance, it is a reminder that business rescue is not a blanket shield. It can pause some creditor actions, but it does not automatically override ownership terms in contracts.

For Capitec, the decision is also a practical win on recoveries, which directly affects credit losses and the cost of lending in South Africa.
